COURSE DESCRIPTION

The graduate course in research methods is designed to give students broad basic knowledge of the subject. The course prepares students to design and carry out research at the level appropriate for a master’s thesis and to competently evaluate research in the field of criminology and criminal justice.

The course focuses on the following areas:

1. Logic and elements of inquiry: Throughout the course, we will emphasize the scientific method. During the first section of the class, we’ll examine the logic of the scientific method. As we discuss types of research design, we will evaluate how well they meet the basic requirements of the scientific method.

2. Sources of information and data: The interdisciplinary nature of criminology and criminal justice combined with advances in information technology have resulted in a bewilderingly rich and constantly changing array of information relevant to our field. We are far beyond the time when anyone can know everything there is to know about even a specialized area, much less about the entire field, making it essential to know how to find information and evaluate its quality.

3. Evaluating research: We will critique research designs and will evaluate their strengths and weaknesses in detail. You may find these assignments tedious and frustrating. Stick with it. Nothing will do more to build your competence and confidence (or better prepare you for comprehensive exams) than the close examination and critique of research.

4. Designing and presenting research: Course assignments will provide the opportunity to practice techniques and to design a research study, giving students a chance to apply the abstract content of the course to topics of their choosing.

5. Ethics and politics of research: We will discuss the requirements of ethical research on human subjects, ways of ensuring compliance, and some ethical issues commonly encountered by researchers in our field. We’ll look at the institutional settings of much research, that is, agencies and academia, and consider how these settings may shape the type and quality of research that is done.

COURSE REQUIREMENTS

Preparation and participation: We will move through the material for this class one week at a time. Weeks will begin at 12:01 a.m. on Mondays and end at 11:59 p.m. on Sundays. It is essential that you block out time each week to do the assigned readings and viewings, to review the PowerPoint slides, to submit assigned exercises, and/or to engage in discussions with your classmates. Don’t fall behind! The material is cumulative and missing a week will put you at a disadvantage going forward.

Exercises (2 points each x 5 exercise assignments = 10 points): We will do exercises to allow you to practice working with the class concepts several times throughout the semester. All exercises must be submitted to the dropbox by 11:59 p.m. on Sundays.

This jet ski case is not based upon an actual incident, but is a composite of several cases.

Injured jet ski rider: Rick Rambo , then 15 years old

Time of accident: Jet ski left beach at approximately 1:00 pm

Description of Accident:

The father of Rick Rambo rented a jet ski for Rick. On the beach behind the Sandy Hotel on Miami Beach.   Rick’s father paid for the jet ski rental and signed the rental agreement. Including a release of liability. No instruction was given to Rick by the jet ski renter. Because Rick told them he was experienced in jet ski operation. There was no communication radio and no rescue flares aboard the jet ski.

Rick took the jet ski through the surf until he was in ocean waves. After some wave jumping, the jet ski stopped and Rick could not get it started again. The jet ski floated north in the Gulf Stream current until Rick was rescued by a passing ship after 50 hours at sea. Rick had injuries from sunburn, jellyfish stings. Dehydration and emotional distress. He had been frightened by sharks which he saw in the water around him. (some of whom looked like his past law professor), had hallucinations during his ordeal. And gave up his plans to be a professional boat captain.

Rambo family

The Rambo family was staying at the Sandy Hotel as registered guests. The hotel featured photos of jet skiing on its website, on posters in the lobby and in the in-room activities book. Rick had convinced has family to find a hotel with jet skiing, so they booked through Hip Hop Travel Agency (HHTA), which recommended the Sandy Hotel for the Rambo family.

The jet skis were rented by an independent concession called Jet Skis R Us (JSRU), which was located on the beach owned by the Sandy Hotel. JSRU paid the hotel a rental fee for the beach concession, which included a percentage of the revenues from jet ski rentals. When asked about jet skiing, the hotel employees would direct hotel guests to JSRU. There were three prior incidents of JSRU jet ski renters who had to be rescued when their jet skis failed at sea.

Rick Rambo (through his father) has brought a law suit against:

  1. Jet       Skis R Us for breach of contract in failing to provide a safe jet ski and negligence in maintenance of the jet ski. Inadequate advice for safe operation and failing to rescue a lost renter;
  2. Sandy Hotel for breach of contract which has an implied warranty of safekeeping for its guests. And for negligence in supervision of operation of the jet ski concession;
  3. Hip Hop Travel Agency for breach of contract and negligence in failing to adequately investigate the safety of the hotel and JSRU operations.

The student lawyers for the Plaintiff Rambo shall each argue all of the above issues.   

Each lawyer will have a maximum 10 minutes for presentation, then cross-examination by the judge, jury and opposing lawyers after all arguments have been presented.

The lawyers may presume facts pertinent for their arguments, such as the actions taken (or not) by the hotel to supervise JSRU, actions taken by Hip Hop to investigate the hotel and JSRU, and the contracts between the hotel and JSRU and between the hotel and Hip Hop. The facts presented by the Plaintiffs and Defendants may vary, since in real courtrooms there are often inconsistent facts presented by witnesses and evidence.

You want to present facts, then argue the law as applied to those facts, to prove your case. Videos and visual objects may be used to help present arguments. Written case brief is required that would focus on either Plaintiff or Defendants side depending on which legal side you are assigned to represent.

Jack, Nolan, Andy, Helen and Erica were the directors of Gemsales Pty Ltd, a  company engaged in the business of importing and supplying jewellery as  wholesalers to the local market.  The company decided that as the market was becoming more competitive it needed  to expand its business as it felt with increased volumes of sales it would be able to  lower its prices and be more competitive. In order to do so it obtained a $4 million  dollar loan from the Friendly Bank Ltd.

$3 million was used to buy more stock and $1  million was used to buy a large new warehouse and showrooms from Traders Pty  Ltd.  Andy was not at the meeting that had made these decisions as he was in hospital  recovering from a serious accident. Erica, as was her usual custom, had not  attended the meeting but signed the requisite documentation agreeing to the  expansion of the business and the getting of the loan. Helen who attended, said she  did not know if she agreed and abstained from voting.

Jack and Nolan both voted to  go ahead with the expansion and the getting of the loan.  At about this time Nolan has established contact with Mark, who was setting up a  new business as a retailer of jewellery. Mark was looking for reliable suppliers, but  said he would not deal with Gemsales Pty Ltd as he did not like Jack, the Managing  Director. Not wishing to miss out on such a lucrative business opportunity, Nolan  arranged to set up his own business as a jewellery wholesaler and a contract was entered into between Mark and Nolan for the supply of jewellery.

Six months later, Nolan resigned as a director. At the same time it was clear the  company had over-extended itself and was insolvent and could not pay the interest  on its loans.  It also became clear that Nolan was a major shareholder in Traders Pty Ltd and the  other directors were unaware of this at the time of the purchase of the warehouse  and showrooms. Furthermore, Nolan had been approaching other established  customers of Gemsales Pty Ltd and had secured orders for his own business.  Advise as to the liability of the parties both under common law and the Corporations Law.

QUESTION 2  “Ben Buckley and Associates” is a talent agency that represents “big name acts”  during their tours of Australia. Ben, the principal of the agency, is extremely pleased  to have secured the contract to act as exclusive agent for a huge American  entertainer named “Slick Parsley”. “Slick”, as he is known to most people, is due to  tour Sydney, Melbourne and Brisbane in a week’s time on his “Fresh Spices” tour.  This contract is a huge career break for Ben, so he has decided to make sure he  does everything himself, both for the kudos, and to ensure nothing is left to chance.  Ben therefore goes to great lengths to ensure all stationary, business cards and  promotional material clearly displays the statement

“Ben Buckley, exclusive agent to  Slick Parsley in Australia”. He has even had this statement included in the extensive  television advertising for the tour. Ben also includes as a term of the contract that he  will be the “exclusive” agent for Slick Parsley while he is in Australia.  Ben, however, is horrified to learn that Slick has two dogs he wishes to take with him  on tour. “Jekyll” and “Hyde” are a pair of miniature maltese/poodle crosses that Slick  simply cannot bear to be apart from. Ben realises that the dogs need to accompany  Slick otherwise he will fret too much to perform. Ben however hates dogs and cannot  bear the thought of touching or having anything to do with them. He therefore hires  renown Sydney “Dog Whisperer” Rusty Wagtail to take care of the two dogs while  Slick is on tour.

Rusty’s contract with Ben states that Rusty will take care of “all matters dog related”  such as feeding, grooming and accommodating. It is also clear that Ben remains  responsible for all other “dog” matters not specifically related to the day-to-day  management of the dogs such as customs declarations and the like.  Rusty subsequently flies to the USA to assist Slick with the two dogs. He is surprised  however to see there are actually three dogs, the third being another female MaltiPoo named “Nessie”. Slick tells Rusty that the other two dogs are in love with Nessie  and cannot travel without her. There is no time to get in touch with Ben for guidance,  so Rusty therefore makes what he considers to be an “executive decision” to board  all three dogs onto Slick’s luxury private jet.

He tells Slick that he will “take care of it”  when they get to Sydney. All three dogs fly off to Australia with Slick and Rusty.  Slick’s plane gets into some engine trouble just off the New South Wales coast,  necessitating a diversion away from Sydney and a subsequent emergency landing at  the small Byron Bay airport. The plane lands and skids to a halt near the perimeter  fence, and all are ordered to evacuate the plane immediately. The crew ensure Slick  evacuates safely, and the three dogs are left for Rusty to take care of. He hurriedly  grabs all three in his arms and jumps down the emergency shute. Then, in a selfless  act of care for the animals, Rusty hurriedly runs away from the plane and throws all  three animals over the perimeter fence to safety.  After medical checks and other such requirements, all are free to go.

Customs clears  two of the dogs due to their prior approvals. Nessie, however, is still at large  somewhere behind the perimeter fence. Rusty finds her, shaken but in otherwise  good health, and once again makes an “executive decision” to simply pick Nessie up and take her to the accommodation with the other two dogs. He tells Slick that  “everything is taken care of”. He does not inform Ben about any of this.  Two days later, however, an ardent fan takes a movie with his video recorder  attached to a drone of the three dogs in Slicks plush rented harbour side apartment.

Word gets out that one of the dogs is in the country illegally. Slick is prosecuted and  expelled from Australia before he could do any concerts, thus disappointing  thousands of eager fans. The three dogs are kept in quarantine pending destruction.  Explain how the law of agency in Australia may impact on the legal positions of Ben,  Slick, Rusty, Jekyll, Hyde, Nessie and “the fans”. In your answer, refer to relevant  legislation and cases where appropriate.

Physiology of Blood Pressure Control

The body’s blood pressure is a measure of the pressures within the cardiovascular system during the pumping cycle of the heart. The blood pressure or systemic arterial pressure refers to the pressure measured within large arteries in the systemic circulation.   Each heartbeat forms a pressure wave that travels down the arterial system. The peak of the wave occurs during systole when blood is under pressure from cardiac contraction making the arterial wall expand.  During diastole when the heart is briefly relaxing-the arterial walls recoil, delivering a pulse.  Systemic circulation provides oxygenated blood to all organs in the body. After perfusing the organs, blood is returned to the right atrium of the heart through the systemic venous system (Lowry, 2016).

Cardiac output is a major factor determining blood pressure, however, as blood flows into the arterial system it meets resistance (in the form of friction) from contact with blood vessel walls.  The main resistance to blood flow occurs in the arterioles, which are smaller vessels formed from the branching of arteries (Lowry, 2016). Resistance from all blood vessels in the systemic circuit combines to produce the systemic vascular resistance, which increases blood pressure in the systemic arterial system.  These two factors together cardiac output and the systemic vascular resistance, generate actual blood pressure in the systemic arterial system (Lowry, 2016).

Overactivity of the Sympathetic Nervous System (SNS)

Decreased arterial pressure is detected by baroreceptors, which trigger a sympathetic response.  This stimulates an increase in heart rate and cardiac contractility leading to increased blood pressure.  The sympathetic nervous system serves as the final common pathway for controlling the smooth muscle tone of the blood vessels.  Most of the sympathetic preganglionic fibers that control vessel function originate in the vasomotor center of the brain stem and travel in the intermediolateral column of the spinal cord and exit with the ventral nerves; they then synapse with postganglionic fibers in the paravertebral ganglia.  Increasing sympathetic activity causes constriction of some vessels, such as those of the skin, gastrointestinal tract, and kidneys (Porth, 1998).

Overactivity of the Renin-Angiotensin-Aldosterone System (RAAS)

The renin-angiotensin-aldosterone system is an essential regulator of arterial blood pressure.  The system relies on several hormones that act to increase blood volume and peripheral resistance.  It begins with the production and release of renin from juxtaglomerular cells of the kidney.  They respond to decreased blood pressure, sympathetic nervous system activity, and reduced sodium levels within the distal convoluted tubules of the nephrons.  In response to these triggers, renin is released from the juxtaglomerular cells and enters the blood where it comes in contact with angiotensinogen which is produced continuously by the liver.

The angiotensinogen is converted into angiotensin I by renin.  The angiotensin I then make its way to the pulmonary vessels, where the endothelium produces the angiotensin-converting enzyme (ACE).  Angiotensin I is then converted to angiotensin II by ACE (Shahoud et al., 2020).  Angiotensin II is a potent vasoconstrictor.  It acts directly on the kidney to increase sodium reabsorption in the proximal convoluted tubule.  Sodium is reabsorbed via the sodium-hydrogen exchanger.  Angiotensin II also promotes the release of aldosterone (Lowry, 2016).
