Overview

This essay requires you to demonstrate an understanding of jurisdiction that is consistent with a biblical worldview. The civil government does not have authority to govern over all the affairs of man. It is critical that we understand that the government does not have jurisdiction to punish everything that is “wrong.” In other words, all sins are not crimes. For example, James Madison believed that religious liberty exists because the government does not have the authority to punish citizens for their beliefs. This principle of limited jurisdiction is consistent with a biblical worldview because it recognizes that God has instituted government, and He has given it authority to accomplish a particular, and limited mission on the earth, which is to punish those who do evil and reward those who do good (See Romans 13:1-4).

In response to a rise in violence, the state of Wisconsin passes a law that enhances the penalty for any offense committed against a victim where the crime is committed “because of hatred for the victim’s race, sex, or religion.” Taking into consideration that hating your brother is prohibited in both the Old and New Testaments, explain whether this “hate crimes” enhancement is a proper exercise of the civil government’s jurisdiction according to the biblical worldview discussed in the course materials. Fully explain your position.

It was not until recent years that state and local governments could be sued due to the doctrine of sovereign immunity. The doctrine of sovereign immunity stated that a governing body of its representatives could not be sued. Because it made the laws in the first place (Schmalleger and Smykla, 2020). Even while confined in prison, inmates still have civil rights.

Federal and state prisoners can file lawsuits with the federal courts stating that their civil rights have been violated by correction officials (Schmalleger and Smykla, 2020). However, not all cases brought to court by inmates are a violation against their rights and at the end of the Prisoners’ Rights Era. Courts had become less sympathetic to prisoners’ claims, as many were frivolous lawsuits (Schmalleger and Smykla, 2020). In order to protect correctional officers changes were made at the state and federal level which have slowed the number of case prisoners have brought against officers (Schmalleger and Smykla, 2020).

The Civil Rights of Institutionalized Persons Act was changed in 1980. Which forces a prisoner to use all means necessary at the state level before a writ of habeas corpus can be filed at the state level (Schmalleger and Smykla, 2020). It can be challenging to sue government officials for allege misconduct and one hurdle that must overcome in order to do so is the qualified immunity doctrine that shields the government official from lawsuits unless the defendant’s conduct violated a right constitutional, or the right was clearly established at the time the misconduct took place (Lass, 2018).

Sovereign immunity is an English law based on a common law principle that the King could not do any wrongdoing. And this law applies to state and federal governments (“Sovereign Immunity,” n. d.). Therefore, sovereign immunity says that the federal and state government cannot be sued without their permission (“Sovereign Immunity,” n. d.). The reasoning behind this law was that if the individuals who made these laws should not be compelled by it (Schmalleger and Smykla, 2020). The federal and state governments can waive their right to sovereign immunity through the Federal Tort Claims Act, which put aside federal immunity for certain wrong claims (“Sovereign Immunity,” n. d.). The Westfall Act says that a feral worker cannot be prosecuted while employed. Some states have complicated laws that have prohibited immunity through governmental action.

Junkies”. “Addicts”. “Crack heads”. These are all common derogatory terms referring to people suffering from drug addiction. Requiem for a Dream depicts four different kinds of drug addiction each leading different outcomes for the characters. Sara Goldfarb (Ellen Burstyn) is addicted to amphetamines,.Marion Silver (Jennifer Connelly), Tyrone Love (Marlone Wayans), and Harry Goldfarb (Jared Leto) are all addicted to heroin. The lives of these characters are all drastically changed as they progress further into their drug addiction. Requiem for a Dream is not like a typical drug abuse film in which the characters have successfully overcome their addiction or are on a path to recovery. Instead, it shows how drug abuse completely engulfs an individual to the point where they are unrecognizable.

The Internet is an invaluable resource for community safety, because it provides public access to information on justice-related issues within communities and throughout the United States. Many law enforcement practitioners have embraced the Internet and made information widely available, allowing access to considerable justice-related data for their jurisdictions.

 

Currently, there are many websites available to the law enforcement community that provide data and information of interest to criminal justice practitioners. Many in the law enforcement community, however, may not be aware of the availability of these resources. Further, to search through the vast amount of data available, law enforcement practitioners have to spend considerable time accessing and conducting searches on individual sites. Access to all of the databases through a single access point would greatly benefit the law enforcement community and allow for the most efficient search functionality and data retrieval.

 

The creation of a law enforcement information sharing portal to provide a single access point would benefit the entire criminal justice community by allowing for more efficiency, effectiveness, and cost savings. The ability of law enforcement to query multiple resources with a common term from a unified interface will deliver a more comprehensive view regarding the search criteria.

The Dru Sjodin National Sex Offender Public Website (NSOPW) is an example of the success that a single access point for searching multiple resources can provide. Prior to the NSOPW, many states had their own sex offender registry systems. However, to conduct a comprehensive search of registered sex offenders, it was necessary to conduct searches on the individual websites of the respective states and territories.

 

 

In 2005, when NSOPW was launched, the public had real-time access to information on sex offender registries throughout the United States and select territories. NSOPW provides an efficient and effective resource to identify registered sex offenders nationwide through a single search from any computer with Internet access. The NSOPW has proven to be an extremely successful and well-used resource since its launch. The success of the NSOPW demonstrates the value of providing a single access point for searching databases to law enforcement practitioners and the public alike.

 

The Internet has revolutionized the accessibility of information, and in a relatively short amount of time, it has evolved exponentially. Advances in technology, which make vital information available via the Internet, have provided the law enforcement community with a cost-effective tool. Using available technology to integrate existing resources will provide law enforcement professionals with expanded access to information that will aid in current investigations and could help prevent future criminal activity.

And it is one of the leading causes of disability. In practice, patients may present with delusions, hallucinations, disorganized thinking, disorganized or abnormal motor behavior. As well as other negative symptoms that can be disabling for these individuals. Not only are these symptoms one of the most challenging symptom clusters you will encounter. Many are associated with other disorders, such as depression, bipolar disorder, and disorders on the schizophrenia spectrum. As a psychiatric nurse practitioner, you must understand the underlying neurobiology of these symptoms to select appropriate therapies and improve outcomes for patients.

Discussion: Treatment for a Patient With a Common Condition

Insomnia is one of the most common medical conditions you will encounter as a PNP. Insomnia is a common symptom of many mental illnesses, including anxiety, depression, schizophrenia, and ADHD (Abbott, 2016). Various studies have demonstrated the bidirectional relationship between insomnia and mental illness. In fact, about 50% of adults with insomnia have a mental health problem, while up to 90% of adults with depression experience sleep problems (Abbott, 2016). Due to the interconnected psychopathology, it is important that you, as the PNP, understand the importance of the effects some psychopharmacologic treatments may have on a patient’s mental health illness and their sleep patterns. Therefore, it is important that you understand and reflect on the evidence-based research in developing treatment plans to recommend proper sleep practices to your patients as well as recommend appropriate psychopharmacologic treatments for optimal health and well-being.
