The state of East Masshampshire is suffering through a fiscal crisis. Last year, the state ran a budget deficit of $34 billion, which constituted 15% of all state spending. State legislators are concerned that without dramatic reduction in spending, the state will not be able to pay for basic services and debt service on its interest within a couple of years.

Therefore, the state passes a series of austerity regulations to cut spending. Among these regulations are the following:

Section 7. Limitation of healthcare services to United States citizens. Commencing on January 1 of the year following the passage of this bill, no person shall be eligible to receive state subsidized health insurance under any health insurance program administered by the state unless he or she satisfactorily proves that he or she is a citizen of the United States.

Section 12. Residency requirements for eligibility for state programs. No person shall be eligible to participate in any state subsidized benefits program. Unless he or she satisfactorily proves that he or she has been a resident of the state of East Masshampshire for at least 24 of the 36 months prior to his or her application.

Pedro is a lawful permanent resident in the state of East Masshampshire who was born in Mexico and immigrated to Texas seven years ago. He moved to East Masshampshire only three months ago.

Pedro is considering filing an action in federal court, challenging the regulations above, based on the following arguments:

1) Pedro contends that Section 7 is unconstitutional because it discriminates against him based on his status as a non-US citizen.

2) Pedro also contends that Section 12 is unconstitutional because of its residency requirement. He is not sure exactly what the logic behind this challenge might be, but he has a feeling there may be something challengeable about this provision.

3) Pedro further shows, using a reliable statistical study, that both Section 7 and Section 12 will have a far greater impact on people of Mexican descent then it will on other people, because many people of Mexican descent in the state have recently immigrated to the United States and are not yet citizens. He therefore claims that both rules are a violation of equal protection.

The state of East Masshampshire defends all three challenges by stating that their laws were not intended to discriminate against anybody, but they are merely necessary to balance the state budget, which is a fiscal necessity.

Please analyze all three of Pedro claims based on the equal protection and/or due process clauses of the United States Constitution. Please make sure to use appropriate case law in furthering your arguments.

She was asked by Stefan, a movie producer, to perform the dangerous scenes for the leading lady in a movie thriller. “Chasing Chérie” at a salary of $5,000 a week for a six-week period. After Wendy read the script. Stefan presented her with a written contract which specified the $5,000 per week compensation and contained other terms standard in these types of contracts. One of the terms required Wendy “to perform the leading lady’s dangerous scenes as called for in the movie script.” Wendy and Stefan both signed the contract.

Milos, with Stefan’s consent, changed the script accordingly and arranged with a wealthy friend living in Montana for the use of one of the fields where he secretly cultivated marijuana.

Might wish to make script changes and you said it was all right.” He claims that “dangerous scenes called for in the movie script” meant the final movie script. Which would include any rewrites during the course of shooting. Wendy denied agreeing to script changes or to stunts not called for in the original script. “How am I supposed to know whether I can do stunts that haven’t even been written yet?” she asked. “I’m not Daffy Duck standing in for Bugs Bunny to be crushed. XBlown up, torn, spindled, and mutilated. Besides, I didn’t sign up for being arrested. What if the police show up while we’re all out there?”

Stefan became angry and screamed at Wendy in the presence of the full cast and crew, “You cowardly b—-! You’re fired. I don’t want people like you working here.” A humiliated Wendy fled the set. As she was getting into her car, the wind blew a hundred-dollar bill against her leg. And she grabbed it and stuffed it in her pocket.

During the months of March through June, Anthony had many in person conversations with his mother and frequently told her that since he has a large family, he is in need of money more than his siblings. As the summer approached, Anthony started turning to this subject with more frequency until the point that rarely a day went by that Anthony hadn’t mentioned something about needing more money than his siblings.

On July 17, Brittany took out a piece of paper and a pen and wrote the following handwritten note:

“I know that my previous will stated that Suzanne gets to live in my house after I die. But I changed my mind. Since Suzanne doesn’t visit me as much as she should, Suzanne should not have the right to live in my house after my death. Also, since my son Anthony visits me all the time and really needs money, he should get 40% of my estate and the other children should only get 20% each.”

Brittany signed her name in script and placed the paper in an envelope in her night table drawer. Later that day, Brittany told her neighbor, Yvonne, that she “changed her will” to give Anthony “more money than the rest of those ungrateful kids.”

On July 31, 2018, Walter died in a tragic car accident in Portland, Oregon, leaving wife Marcy and three children.

At times, I imagine this was very disheartening. This project proposal/essay is your chance to be creative and think of something that you might actually be able to do to make change for women and girls.

 

You task is to design a project that brings some of the issues that we have been discussing in class out into the larger community. The community can be UTEP, El Paso, the border region (you get to decide this). The purpose of this project proposal is to think about a need that has not been met or a problem that has not been solved. And to create a project that responds to the issue. The project must be focused around women and girls or you must be able to relate it to a topic that we discussed over the course of the semester. Some general examples of projects that would be acceptable are:

A voter registration drive for women who might not otherwise vote or have access to the polls, a bike collection for women that might have issues with transportation, a car repair class for women, a girls night out for college students to provide them with information about sexual assault, etc… the list can go on an on. Remember, this is your chance to be creative and to create something that can actually be done in your community. This is also a chance for you to consider the problems that women and girls are facing in your community and consider responses to those issues that might improve the lives of women and girls.
