Violation of Title Vii by General Aptitude Test and Math Test

  • Flora Tucker, a black female, applied for a management position in Ames Department Stores in Seattle. After completing her application and two interviews, she was asked to take a math test and a general aptitude test. As a result of her score, she was disqualified from consideration for the management job. US Judicial Review

The concept of judicial review was pioneered by the United States. Some maintain that one of the reasons the doctrine was readily accepted. In this country was that it fit well with the checks. And balances designed by the founders. Today, all established constitutional democracies have some form of judicial review—. The power to rule on the constitutionality of laws—but its form varies from country to country.

For example, Canada’s Supreme Court can exercise judicial review. But is barred from doing so if a law includes a provision explicitly prohibiting such review. France has a Constitutional Council that rules on the constitutionality of laws before the laws take effect. Laws can be referred to the council for prior review by the president. The prime minister, and the heads of the two chambers of parliament. Prior review is also an option in Germany and Italy, if requested by the national or a regional government. In contrast, the United States Supreme Court does not give advisory opinions; the Supreme Court will render a decision only when there is an actual dispute concerning an issue.

You have been hired as a management consultant by a large company to examine the company’s business decisions regarding employee protections. The applicable laws are federal anti-discrimination laws, federal health and safety laws, and employer firing practices related to the employment-at-will (EAW) doctrine.

In response to the three questions below, write a 4–6 page paper in which you do the following:

  1. Analyze, identify, and explain recent legislation, within the last 10 years, that helps to protect employees from discrimination in the workplace. Provide at least two federal legislative protections. Provide some insight when the federal legislation conflicts with the state.
  2. Explain the EAW doctrine and all exceptions to the doctrine. Look at the scenarios below and determine whether the decision to fire the employee is a smart one. Identify why or why not, and determine all the possible exceptions per the EAW doctrine that are, might be, or could be applicable if the employee sues for wrongful termination.

She noticed that a worker was protesting that no Asian American employees had gotten a raise in two years at the company.     • Brian, the head of the accounting department, refused to sign Lori’s leave request for jury duty. Lori is a tax attorney in his department. Brian wants to fire Lori for being absent without permission during their busiest time—tax season.
    • Peter has worked for the company for one year. He has a rare form of liver disease and works with chemicals that make his condition worse. Peter does not want to stop working, but his boss is not happy with his performance and wants to let him go.
  3. Determine the federal law regarding undocumented workers and whether they are eligible for state workers’ compensation in the United States. Advocate for or against this practice and substantiate your response with research to support your position.

Legal Conflicts by Law

Written Assignment #2:  Recall that Kyle and his family own a successful produce business near Whitehouse, AL, close to Hamilton.  Their produce (fresh and canned vegetables, fruits, etc.) is sold under their own label, Alabama Sunshine.    Kyle likes the small town environment of Whitehouse where business is usually done with a phone call or a handshake.  Unfortunately, Kyle is a bit too trusting. Assuming that all people are as honest as he is, or tries to be.

Having received the $20,000 deposit from Alabama Best Foods (recall WA1), Kyle decided that the family’s roadside market needed something to draw attention to it, like a scene painted on the front wall.   Kyle saw an ad by Pai Casso, a local painter, and contacted Pai about painting the scene.  Pai agreed to do the painting for $4,500.  Unfortunately, Pai, who never intended to paint the market but only intended to take Kyle’s money, had a reputation for not starting painting commissions or starting the work. But never finishing as he had done this to several other businesses in nearby Winston County.  Pai even got his friend, James Bama, to talk with Kyle about how competent Pai was. And to explain that Kyle should not be concerned about paying Pai a commission in advance.

Upon his advice, Kyle wrote Pai a $2,000 check one week before he was to start the job.  Pai transferred the check to Clyde Caldwell in exchange for Clyde’s 1995 Ford Windstar van. Which was worth $1,800.  Before Clyde had a chance to deposit the check, the local Winfield newspaper ran several news stories about Pai and the fraud that he had committed.  In the meantime, Clyde transferred the check to Bama, who then transferred it to Sal Dali.  Bama gave Clyde value for the check, and Dali gave Bama value.  Kyle was unaware of these transactions and had not read the stories about Pai in the local paper.

Computer Services (FCS)

Putting any problems with Pai out of his mind, Kyle liked the idea of upgrading the family market. And decided to purchase some computer equipment from Friendly Computer Services (FCS).  Kyle worked out the details with FCS; however, when the FCS’ technician arrived to install the equipment, Kyle realized that he was out of checks, having written the last one to Pai.  He needed to pay for the equipment and installation so he found a check that was drawn “payable to Kyle, in trust for Donald.”  Donald is Kyle’s minor nephew who periodically receives disbursements from a trust fund and Kyle is his guardian.  Kyle, wanting to get the equipment installed, indorsed the check to FCS in payment for the computer equipment and installation costs.  FCS accepted the check as indorsed and completed the installation.

Kyle knew that his computer skills were lacking and that installation of the any new computer system can have glitches and would involve a learning curve, especially for Kyle and his family to get up-to-speed.  Elbert has a business in which he consults with small businesses.  Kyle contracted with Elbert to daily stop by and check on the new system, answering any questions about its operation.  Since Elbert charges by the hour and since Kyle intends to take a few days off back down at Gulf Shores, AL (to celebrate his contract with Alabama Best Food.), Kyle gave Elbert a signed check with the amount blank for Elbert to fill in based on $100/hour.  Actually, Kyle left the check on top of the computer just before he headed to Gulf Shores.

Kyle also had a check on top of the computer that had the amount of $500 filled in, but no payee and no signature.  Elbert got greedy and took the check, converting the $500 to $5,000 and signed Kyle’s name.  Then Elbert filled out the check that Kyle had given him in the amount of $4,000, rather than the $200 he had earned at $100/hour.  Elbert transferred both checks to Farley, a holder in due course, who is now seeking payment from Kyle.

Three months have passed since Kyle wrote Pai Casso the $2,000 advance check and, as of yet, no paint has been applied to the roadside market.  Kyle is aware of the transfer of his check from Pai to Clyde to Bama and then to Dali.  He is also concerned about the check that he gave FCS.  And, now he is being contacted by Farley.  Since Kyle knows that you are knowledgeable in the finer , he comes to you for guidance on these situations.

1. Liability, defenses, and discharge

Several ethical issues reside in the law of negotiable instruments.  For example, fraud in the inducement is treated as a personal defense and fraud in the inception is treated as a real defense.  Or, the definition of “value” for purposes of a holder-in-due-course being different from the definition of “consideration”, with an unfulfilled promise qualifying as consideration but not considered as “value given” under Article 3. What is the purpose and effect of eliminating the holder-in-due-course provisions for consumer credit transactions (FTC rule)?  Will doing so raise the cost of borrowing for these consumers?

2. Banking

For this DT, let’s look at some issues in banking.  The law generally places the risk of forgery on the payor bank, yet places the risk of unauthorized completion of the drawer.  Is this fair?  What factors would justify a difference in the liability of the bank or a difference in the liability of the drawer?  Banks have rigid and short deadlines to decide whether or not to pay items.  The midnight deadline may force a bank into making payment decisions before it has adequate information.  Is this fair?
