Introduction

A controversial issue today in the American legal system is the justification of the use of force by police officers, given the actions and conduct of citizens. In this assignment, you will explore the requirements for use of force, constitutional rights pursuant to the Bill of Rights when it comes to free speech, and criminal defenses justifying actions.

Instructions

Write a 2–3-page paper in which you:

• Specify the key requirements for police officers in determining the lawfulness of the use of force in making an arrest and what is meant by “reasonableness.”
• Evaluate how free speech rights clash with the rights of others and the need for public order today.
• Argue for or against the regulation of the First Amendment when it comes to speech that could or might incite “imminent lawless action or conduct.”
• Analyze the defenses within today’s criminal law system.
• Evaluate the fairness of the common law defense of necessity when citizens use deadly force.
• Use at least three sources to support your writing. Choose sources that are credible, relevant, and appropriate. Cite each source listed on your source page at least one time within your assignment. For help with research, writing, and citation, access the library or review library guides.
• Write clearly and concisely in a manner that is grammatically correct and generally free of spelling, typographical, formatting, and/or punctuation errors.

Resource Conservation And Recovery Act

This unit has presented the regulatory environment related to industrial and hazardous wastes. The required unit resources and unit lesson presented aspects of the historical and current regulatory environment, Resource Conservation and Recovery Act (RCRA) requirements, and the impact of nonuniform international environmental laws.

For this assignment, review the case study that was in the required unit resources “Hidden Externalities: The Globalization of Hazardous Waste” concerning the Colbert brothers’ hazardous waste business.

In your case study, discuss the Colbert brothers’ business and how they were able to conduct this business operation.

In addition, address the following items:

• Assess the historical and current regulatory environment on this case.
• Summarize RCRA requirements regarding this hazardous waste case.
• Appraise the impact of nonuniform international environmental laws concerning this case.
• Assess the ethical standards for the Colbert brothers and if their punishment fit their crime.
• State your opinion on how the case was handled.

You do not need to write your case study in the order of the above items. Weave the items into your paper to create a flowing, readable document with smooth transitions.

Your case study must be at least three pages in length with a title page and reference page (title and reference pages do not count toward the minimum page requirement).

Besides using the source from this article in your case study, locate an additional peer-reviewed article from the CSU Online Library that centers on RCRA requirements and the current regulatory environment regarding hazardous waste. The article must be no more than five years old. Also, it may be helpful to utilize the Environmental Protection Agency websites listed under References.

Budding entrepreneurs

What is the TV Show “Shark Tank?”

Budding entrepreneurs get the chance to bring their dreams to fruition in this reality show from executive producer Mark Burnett. They present their ideas to the sharks in the tank – typically five titans of industry who made their own dreams a reality and turned their ideas into lucrative empires. The contestants try to convince any one of the sharks to invest money in their idea. When more than one of the sharks decide they want a piece of the action, a bidding war can erupt, driving up the price of the investment.

Select a rather current Shark Tank Episode (if possible) – go to https://abc.com/shows/shark-tank/episode-guide, https://abc.com/shows/shark-tank, ABC on-demand, or find episodes online (YouTube, etc.).  Choose one of the products or businesses presented and discuss the following based on the feasibility of a potential business.  Integrate concepts from chapters covered throughout the semester.  Please note the season #, episode #, date aired of show used.

• Overview of Product or Business Proposed
• Type of Business (Sole Proprietorship, Partnerships, Corporate, Franchise, etc.)
• Business Environment (Briefly discuss the following environments, if relevant: Economic and Legal Environment; Technological Environment; Competitive Environment; Social Environment; Global Environment)
• Business Management Considerations (Organizational, Managerial or Leadership Issues; Production and Operations Management)
• Marketing Considerations (Four Ps, Marketing Concept / Plans, Marketing Research, etc.)
• Financial Considerations (Is there a financial plan?; Is it realistic?; Are funds requested feasible?; Will this product make money? Etc.)

All papers must be typed in Word, double-spaced using Times New Roman 12 pt. font, with one-inch margins all around.  The length of the paper should be at least 4 to 5 complete pages (not part of a page).  The paper must include an introduction, body, and conclusion.  Use headings to better guide the reader.
