Scenario

In June of 2016, you begin your first week as an intern at the Happy Town Police Department. As an intern, you develop a good rapport with Police Chief Rodney Hurt.

On the second week of your internship, you begin to ask questions. (To the police officers you have been working with at the department) concerning the Uniform Crime Rate (UCR). You tell them you are taking a class at Strayer University and are interested in gaining a better understanding of statistics. And the application of statistics to law enforcement.

The following day you are greeted by Sergeant Gunn. She provides you with Part I crime data over the past five years that were submitted to the Federal Bureau of Investigation for the Uniform Crime Report. The Part I information provided to you by Sergeant Gunn is a compilation of crime data. Drawn from four areas: Happy Town, Frown Town, Smooth Town, and Cool Town.

After a review of the crime trends. You are alarmed at the rate of crime reported in these four towns. You are now curious to dig a little deeper and make some comparisons across the data provided to you.

Your task is to write a four-page report for the Chief of Police Rodney Hurt. He will use the report for his news conference regarding the public’s concern for the increase in crime over the past five years. In the report, you will include the following:

Have you ever entered into a contract without really understanding all of your obligations involved in the contract? You might say that you have not done that, but think whether you really understand all of the terms of the contract for your cell phone service, your cable or satellite television service, the loan for your car, or your lease or mortgage. Is there anything each of us can do to avoid entering into contracts that we do not understand without missing out on things we need and want?

Calvin had been an avid coin collector for many years. And   the most valuable coin in his collection was an uncirculated, mint condition.  1943 Lincoln penny made of copper. (Most pennies made during World War II were   made of zinc because copper was needed in the war effort). That penny had a   value of between $60,000 and $95,000.

In August of 2017, Calvin had a serious stroke that left   him unable to speak or walk. But his doctor assured his family that Calvin   would recover over time with intensive therapy.

Calvin was a widower and did not have any children, but he   had several nephews who visited him from time to time as he recovered. None   of the nephews had any real interest in Calvin’s coin collection. One of   Calvin’s nephews, Billy, who visited Calvin more often than the other   nephews, sometimes listened to Calvin talk (talking was a part of Calvin’s   therapy) about his mounting medical bills and his coin collection, but Billy   never showed much interest in the medical bills or the coin collection.

Calvin’s recovery progressed

In October, as Calvin’s recovery progressed slowly, Billy   visited Calvin and told Calvin that he had been reading about coin   collecting, and he realized that Calvin’s collection, especially the 1943   Lincoln copper penny, was valuable, and Billy suggested that Calvin should   consider selling the 1943 Lincoln copper penny and use the proceeds to pay   his medical bills. Calvin resisted the idea at first, but Billy continued to   urge Calvin to sell the penny so that he would not have to worry about the   medical bills. Finally, when Billy told Calvin that he would arrange the sale   of the penny for a commission of just 5% of the sale price of the penny,   Calvin began to think that selling the coin might be a good idea.

Calvin’s collection

He was   still a little confused about how the sale would work and what Billy would do   to make sure that the penny would be sold for the best price. Calvin told   Billy that he thought that the penny was worth almost $100,000, but Billy   assured Calvin that the market had changed recently, and that the penny was   now worth $40,000 to $45,000. Eventually, Calvin allowed Billy to sell the   penny for the best price he could get and to take a 5% commission for   arranging the sale of the penny. Billy then sold the penny to a friend for   $40,000, took his 5% commission, and paid the remainder of the sale price to   Calvin.

A few months later, as Calvin continued to recover, he   read a story in a coin collecting magazine about how an uncirculated, mint   condition, 1943 Lincoln penny made of copper had just sold at auction for   more than $100,000, and Calvin began to wonder if Billy had taken advantage   of him. Calvin consulted a lawyer and asked the two questions below.

  • Did he (Calvin) have the mental capacity to enter        into the contract when he agreed to let Billy sell the penny? What would        he (Calvin) have to prove to show a court that he did not have the        necessary mental capacity when he authorized Billy to sell the penny?
  • Did Billy exert undue influence over Calvin to cause        Calvin to enter into the contract that allowed Billy to sell the penny?

Introduction

Police work involves keeping law and order; they are dedicated to the community to

protect the citizens; the activities involved in police work include law enforcement, public safety,

public service, civil service, rescue services, and protection of the community’s property. Every

community needs to have police officers because they help in crime investigation and crime

prevention. By enforcing the state’s laws, the police work is faced with bias, prejudice, and

discrimination in police work.

Bias is the inclination for or against one group that is considered to be unfair, the bias in

police work can occur when a group of police officers is against some people in the community,

for example, in America, the murder of the American-African man, George Floyd by the

policemen in Minneapolis and the mow down of Jacob Blake by the policemen in Wisconsin

raised an issue in the white officers using the white supremacy to be biased to the blacks. This

led to unrest protests in the United States of America because people felt bias in the police work,

and there was equal treatment from the police when carrying their duties. (Peeples, 2020) The

police must be fair to everybody regardless of the status, color, tribe, language, and even the

region one comes from. Bias in policing also occurs when a police officer takes actions based on

his own biases other than relying on the evidence and behaviors that could enable the policemen

to think that a person is guilty or not. Although the public mistakenly believes that profiling is

against the law, and police officers are prohibited from employing this exercise. Culprit

description is lawful, and it is a lawful approach applied every time in rule implementation. The

partiality-based description is against the law and has no reason to be used as a legitimate

technique in solving and preventing crimes in society. A bias-based profile does not pay

anybody, neither the police department nor the citizens, but as a result, it summons suspicion

from the community, great media study, and the probability of law actions from the division

about the benefit of law and people rights contraventions. Although sometimes the police

officers need to consider the personal origin, lifetime, sexuality, faith, and additional elements

when producing the culprit description, it will be imperative to determine who had a reason and

the ability to perform the claimed offense.

work occurs when the intolerant individuals are attracted to intolerant institutions. When some

resulted in protests in many cities in America and the black lives national movement. The

prejudice in police work in America, from the formal polls across New York City end, question

and frisk routine, the programs find that the police are using their prejudice on citizens by; the

program discovers that African-American and Iberians are more probably to behold on, pressed,

smacked, sprinkled and banged compared to white citizens who are ceased. This shows how the

police use prejudice when carrying their duties; this shows how the disparities occur in civilians’

treatment.

Discrimination in police work

Discrimination is the unjust treatment of different categories of people, especially on

race, age, sex, and disability. (Henderson, 2020) Discrimination in police work has been a major

issue in America that has raised concerns from the world. The ongoing movement of black lives

matter resulted from discrimination in police work. The killing of black man George Floyd by

the white police officers raised concerns from the black community living in the United States of

America to feel that they are discriminated against; one of New York programs indicates that

there is unfair treatment from the police to the citizens. The program highlights that Latinos and

blacks are likely to be beaten, pushed, and handcuffed while the other white citizens are stopped.

The New Jersey law states that, even if an individual has committed a crime when the police are

arresting you correctly, they must treat you in a way that is discriminatory based on the race, sex,

ethnicity, national origin, origin, religion, creed, sexual orientation or other guarded

classifications. The police officer should not make an arrest based on these criteria or treat the

individual in a hostile and abusive way even when they have a proper reason to interact with you.

The police officers should bear in mind that these are prohibitions against violating the citizens’

rights. Wherever they go, the law against discrimination should go with them, and they must

obey it. The police officer mustn’t just enforce the law, but they must obey it; if not so, it’s not

the law at all.

Conclusion

It’s important for the government and the organizations concerned with the rights of

human beings to put pressure on the police when carrying out their duties. Many incidents have

evolved from police practices, such as bias, prejudice, and discrimination when they are

performing their duties; these incidents have resulted in America being divided. Such incidents

like the white police using white supremacy to be unfair to African Americans when performing

Nicastro injured his hand while using a metal-shearing machine that J. McIntyre Machinery, Ltd. (J. McIntyre), manufactured in England, where the company is incorporated and operates. Nicastro filed this products-liability suit in a state court in New Jersey, where the accident occurred, but J. McIntyre sought to dismiss the suit for want of personal jurisdiction. Nicastro’s jurisdictional claim was based on three primary facts: A U. S. distributor agreed to sell J. McIntyre’s machines in this country; J. McIntyre officials attended trade shows in several States, albeit not in New Jersey; and no more than four J. McIntyre machines (the record suggests only one), including the one at issue, ended up in New Jersey. The company knew that its US distributor can potentially sell the product in any state. The company did not advertise, travelled or contact any New Jersey resident. Do you think the J. McIntrye Machinery is subject to personal jurisdiction in the state of New Jersey? Why or why not?

Scenario I: Courts and Alternative Dispute Resolution

Alana Mendes suffered from Alzheimer’s, and was admitted to the Bay Pines Rehabilitation Center. Because of her mental condition, Alana’s daughter, Juanita. Completed the admissions paperwork and signed the admissions agreement. The admissions documents included a clause that required parties to submit any disputes for arbitration. When Alana was released from the center four months later. She sued for negligent treatment and malpractice during her stay. Bay Pines moved to require arbitration.

This is a claim of negligent care, not a breach of a commercial contract. Is it ethical for medical facilities to impose mandatory arbitration? Is there really any bargaining over such terms?

Should a person with limited mental capacity be held to the arbitration clause agreed to by the next-of-kin who signed on behalf of that person?

Scenario II: Due Process and ADR

In 2016, a report found extremely high rates of obvious plagiarism in the theses of graduate students in the MBA program in the College of Business at Western State University. Two full-time faculty members and three adjuncts were identified for ignoring their ethical responsibilities and contributing to negligence toward issues of academic misconduct. Assistant Professor Mark Day was one of the five professors identified in the report.  Therefore the findings were published during a press conference in May 2016. The dean of the College of Business, Derrick Dawson, removed Day’s responsibilities for advising graduate students. And scheduled him for undergraduate courses for the next semester. Day filed suit in a federal district court against Dawson, the university, and others for violating his due process rights by publicizing accusations about his role in plagiarism without providing him with a meaningful opportunity to clear his name in public.

What does due process require in these circumstances?

Would the outcome be different if a mandatory arbitration clause was provided in Day’s contract and the university filed to dismiss the suit to require arbitration?

Scenario III: Regulatory Agencies and Ethics

Jessica Smith is the vice president of new drug development at Generic Phama, Inc. A pharmaceutical research company in Boston, Massachusetts.  One year ago, she filed an application with the Food and Drug Administration (FDA). To obtain approval of a new drug for treating cancer.  Smith met Joe Spencer at a convention three months ago and invited him to her room at the hotel.  The two parted ways.  Spencer worked as the director for approval of new drugs at the FDA.  Two weeks later, Spencer wrote Smith a letter on FDA letterhead stating. “It was nice to see your name cross my desk on our company’s application for approval of the new cancer drug.  I’d really like to see you again.  Why don’t you come visit me in Washington this weekend?”

Smith considered requesting that the petition be referred to another director at the FDA.  However, she is concerned that the  transfer would delay the approval process for at least a year.  Smith’s chief scientist advised her that a key competitor plans to introduce a similar drug on the market in three months.

Illegal Alien In USA

An illegal alien is an alien who has entered the U.S. or some other country in violation of the law. An alien is any person, who is not a citizen, but is not necessarily a person who is entering the U.S. or some other country illegally. Different countries have different opportunities for persons with or without skills to earn higher wages than they would receive for the same work in their own countries. If illegal aliens can double their pay, they have a strong incentive to remain in the country, even though they have an illegal status.
